Terms of Service
These Terms of Service (“Terms”) are an agreement between you and Landon Fish (“StudyFish,” “we,” “us” or “our”) for your use of studyfish.app and the StudyFish app (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
Please read Sections 12 and 13 carefully. They limit our responsibility to you.
1. Who can use StudyFish
- You must be at least 13 years old.
- If you are under 18, you may use StudyFish only with the permission of a parent or guardian who has read and agreed to these Terms. By using StudyFish, you confirm that you have that permission. A parent or guardian who allows a teen to use StudyFish agrees to these Terms on the teen’s behalf and is responsible for the teen’s use.
- One person per account. Give accurate information, keep your password secure, and tell us right away at landonfish5@gmail.com if you think someone else has used your account. You are responsible for activity on your account.
2. What StudyFish does
StudyFish helps you study. You can upload course materials; StudyFish identifies the concepts in them, generates practice questions, grades your answers, tracks your mistakes, estimates your mastery and exam readiness, and builds a study plan you control. Finn, our AI study assistant, answers questions about your studies and your plan.
StudyFish is currently free. If we add paid features, we’ll tell you in advance, and you won’t be charged unless you agree.
We may add, change or remove features. If we shut down the Service entirely, we’ll try to give you at least 30 days’ notice and a chance to request a copy of your information.
3. AI features and study estimates
StudyFish uses artificial intelligence, including models from OpenAI. Please keep these limits in mind:
- AI-generated questions, explanations, grades and feedback can be wrong or incomplete.
- Mastery and readiness figures are estimates based on your activity in StudyFish. They are not predictions or guarantees of your grades or exam results.
- Study plans are suggestions. You decide what and when to study.
- Dates and details StudyFish reads from your syllabus or other materials may be wrong. Always check them against your official course information.
- Finn can suggest changes to your plan, but it never changes your plan unless you confirm. You are responsible for changes you confirm.
- StudyFish doesn’t replace your teachers, tutors or academic advisors. Nothing in StudyFish is professional advice (such as medical, legal or financial advice), even if your course covers those subjects.
4. Academic integrity
StudyFish is for learning and practice. You are responsible for following your school’s rules. Don’t use StudyFish to complete graded work for you, to get help during a test or exam, or in any other way your school or instructor doesn’t allow. Don’t upload exam or assignment materials you aren’t permitted to have.
5. Your content
“Your Content” means everything you upload or enter in StudyFish, including materials, course information, answers and messages to Finn.
- You own Your Content. These Terms don’t change that.
- Permission you give us. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, process, analyze and display Your Content only as needed to provide, secure and improve the Service for you. This includes sending it to our service providers, such as OpenAI, as described in our Privacy Policy. This permission ends when you delete Your Content or your account, except for copies in backups until they are replaced and anything we must keep by law.
- What we don’t do. We don’t sell Your Content, use it to train AI models, or show it to other users.
- Your responsibility. You confirm that you have the right to upload Your Content. Your own notes, and materials your instructor provides for your personal study in the course, are generally fine. Don’t upload other people’s personal information (such as classmates’ grades), or confidential material you aren’t allowed to share.
- What StudyFish generates for you. You may use the questions, explanations and plans StudyFish generates for you for your own personal, non-commercial study. Other users may receive similar output.
6. Acceptable use
When using StudyFish, you agree not to:
- break any law or violate anyone else’s rights;
- upload content you don’t have the right to share, or content that is illegal, hateful, harassing, sexually explicit, or contains malware;
- access or try to access other users’ accounts or information;
- probe, test or get around our security, rate limits or usage limits;
- misuse the AI features, for example to produce harmful content, to get around their safeguards, or for large-scale use unrelated to your studies;
- scrape, copy, decompile or reverse-engineer the Service, except where the law allows it;
- resell, rent or commercially provide StudyFish to others;
- create accounts by automated means or pretend to be someone else;
- interfere with or overload the Service.
We may remove content and suspend or close accounts that break these rules.
7. Copyright
We respond to notices of copyright infringement under the Digital Millennium Copyright Act. See our Copyright Policy. We close the accounts of repeat infringers.
8. Our property
The StudyFish name, logo, the Finn character, the app’s design and its software belong to us. We give you a limited, personal, non-transferable and revocable permission to use the Service as these Terms allow. If you send us feedback or ideas, we may use them freely without any obligation to you.
9. Other services
StudyFish relies on service providers such as Supabase, OpenAI, Vercel and Resend. We aren’t responsible for their outages or for websites we link to that we don’t control.
10. Privacy
Our Privacy Policy explains how we collect, use and protect your information. It is part of these Terms.
11. Ending your use
- You can stop using StudyFish at any time. To delete your account, email landonfish5@gmail.com from your account’s email address.
- We may suspend or close your account if you break these Terms, if your use creates a risk to StudyFish or other users, if the law requires it, or if we shut down the Service. Where reasonable, we’ll tell you first.
- After your account is closed, we delete your information as described in our Privacy Policy. Sections 5 (“What we don’t do”), 8, 12, 13, 14, 15 and 17 continue to apply.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON’T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI-GENERATED CONTENT WILL BE ACCURATE, OR THAT USING STUDYFISH WILL IMPROVE YOUR GRADES.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, STUDYFISH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GRADES, ACADEMIC STANDING OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50. Some places don’t allow these limits; where that’s the case, they apply only as far as the law allows.
14. Responsibility for misuse
If you (or, for a teen, the parent or guardian) use the Service in a way that breaks these Terms or the law, or upload content you didn’t have the right to share, you agree to cover our reasonable costs from claims by others that result from it, including reasonable legal fees.
15. Resolving disputes
- Talk to us first. If you have a problem with StudyFish, email landonfish5@gmail.com. We’ll try to resolve it informally within 30 days.
- Governing law. These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-law rules.
- Where disputes are heard. Any dispute that isn’t resolved informally will be heard in the state or federal courts located in Dubuque County, Iowa, and you and we agree to those courts’ jurisdiction. Either of us may instead bring a claim in small-claims court if it qualifies.
- Nothing in this section takes away consumer protection rights that the law of the place you live doesn’t allow to be waived.
16. Changes to these Terms
We may update these Terms. For important changes, we’ll tell you by email or in the app at least 14 days before they take effect, unless a change is needed sooner for legal or security reasons. We may ask you to accept the new Terms to keep using StudyFish. If you keep using StudyFish after changes take effect, you accept them.
17. General
- These Terms, our Privacy Policy and our Copyright Policy are the whole agreement between you and us about the Service.
- If any part of these Terms can’t be enforced, the rest still applies.
- If we don’t enforce a part of these Terms right away, we can still enforce it later.
- You may not transfer these Terms to anyone else. We may transfer them if StudyFish is sold, merged or reorganized.
- We may send you notices by email to the address on your account.
